Nigel Fry was recently called upon as an expert witness in a case where a firm of accountants were being sued.
The central question revolved around the issue of a company having the ability to comply with the law relating to the purchase of own shares.
Having initially produced a detailed report on behalf of the defendant accountants for submission to the Court, Nigel then sat in the witness box to be cross examined by both sides’ barristers. The Judge accepted Nigel’s evidence that the company was capable of complying with the law relating to the purchase of own shares and the case therefore failed.
